SAN MATEO COUNTY DEMOCRATS ADOPT RESOLUTION REQUESTING DALY CITY COUNCIL REVERSE DECISION OF 50% SALARY REDUCTION OF CITY CLERK

SAN MATEO COUNTY, CA - At its April 16, 2009 general meeting the San Mateo County Democratic Central Committee adopted a resolution calling upon the City Council of Daly City to reverse its decision to reduce the salary of the elected city clerk by over 50 percent.
"The San Mateo County Democratic Central Committee is publicly calling upon the Daly City Council to reverse its decision of March 9, 2009 to drastically reduce the salary of the duly elected City Clerk of Daly City," said David Burruto, Chair of the San Mateo County Democratic Central Committee. "The Committee expressed its concern that the City Clerk's salary was significantly reduced but the City Council has not adopted commensurate reductions in the salaries of any other city employee nor for did the council similarly reduce the compensation of individual council members."
The San Mateo County Democratic Central Committee is the official arm of the Democratic Party in San Mateo County . The adopted resolution reflects the official position of the Democratic Party regarding the City Clerk of Daly City.

Whereas the Honorable Daly City Council has recently reduced by more than one half the salary of Annette Hipona, the independently elected City Clerk of Daly City.
Whereas the Council did not reduce the City Clerk's salary until after the election, and has not imposed a similar 50% reduction upon their own salaries or upon the salaries of any other City officer or employee.
Whereas the Attorney General has previously determined that similar mid-term reductions in the salary of an elected city official would violate Article 1, Section 10 of the United States Constitution and Article I, section 9 of the California Constitution (See 80 Ops.Cal.Atty.Gen. 119 (1997); also 89 Ops.Cal.Atty.Gen. 159 (2006) ["In 80 Ops.Cal.Atty.Gen. 119 . . . we determined that a mayor's additional compensation may not be reduced by the city council during his or her current term of office because of the 'contract clauses' of the United States and California Constitutions . . . ."].)
It is therefore resolved that the San Mateo County Democratic Central Committee calls upon the Honorable members of the Daly City Council to reverse this mid-term reduction in the salary of the City Clerk."
